How we collect information from you

We may collect and process the information that you give us. You may give us information about you by filling in any forms, surveys etc. on our site or by corresponding with us by phone, email, or otherwise. This may include information you provide when you subscribe, register, enter a promotional activity, sign up for an alert, complete a survey, or participate in any discussions or other social media activities, make enquiries, provide feedback, or report a problem with our site. We may also collect information if you contact us offline, e.g. by telephone, fax, or post. The information you give us may include your name, address, email address, and phone number. We may collect anonymous information about you when you visit our site through the use of various technologies including the use of 'cookies' and 'web beacons' which may include technical information, such as:

  • the Internet Protocol (IP) address used to connect your computer to the internet, any login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform;
  • information about your visit, including the full Uniform Resource Locators (URL) clickstream to, through, and from our site (including data and time), items you searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page, and any phone numbers used to call our contact number.

How we use your information

We use information held about you for technical purposes, such as the functioning of our services and marketing purposes if you agree to register with us. From time to time, we may use your information to contact you with details about our products and services which we feel may be of interest to you. We may also use and analyze the information that we collect in order to administer, support, improve, and develop our site. If you do not want the information we hold on you to be used in these ways, you must contact us by emailing us at support@pics.io and establishing your preferences. You can also review, download, or request the deletion of your personal information right from the user interface of our products. You can find this functionality on your account page.

Personal information and content

Personal Information means information that by itself explicitly identifies an individual (such as name, email address, photo, links to other resources) or that can be combined with other information to identify an individual.

If we hold any personal information about you which is incorrect or if there are any changes to your details, please let us know so that we can keep our records accurate and up to date.

We will delete all your personal data 3 years after your last interaction with our service. The period of storing personal data is determined by the respective statutory retention period. After this period expires, the corresponding data is routinely deleted, as long as it is no longer necessary for the fulfillment of the contract or the initiation of a contract. Please note that you have the right to delete your personal information from our service or restrict the processing of your personal information by our staff and our subcontractors. You need to contact us at support@pics.io or use the tools available on your account page to delete the data or restrict the data processing.

Security and storage information

We will keep your information secure by taking appropriate technical and organizational measures against its unauthorized or unlawful processing and its accidental loss, destruction or damage. Please remember that the internet and email are not always secure and whilst we will always do our best to protect your information, we cannot guarantee that your information will remain secure, so if you transmit any information via our site or email any information to us, you do it at your own risk. If we have given you or if you have chosen a password to certain services, please keep your password safe. We will not share this password with anyone either.

TopTechPhoto inc. will not view, access or use your Content, including your Personal Information, except if it is needed to deliver our Products in the framework of Product support authorized by the Customer. In the course of providing Product support requested by the Customer, TopTechPhoto inc. may have incidental access to Content. Any Customer request for Product support will be deemed as a permission for us to access particular Content for the limited purposes of providing the requested Product support. The customer, as the data controller, is responsible for furnishing any notices or obtaining any consent required by law from the relevant individuals.

Personal Information, including your Content, does not include Aggregate Information, which is the information we collect or process about a group or category of data. Aggregate Information cannot be attributed to any individual. We may use and share such Aggregate Information to improve Products, develop new products, understand and/or analyze usage, demand, and general industry trends, develop and publish white papers, reports, and databases summarizing the foregoing, and generally for any purpose related to our business. Aggregate Information may be derived from the information provided by any Customer, from the use of our Products, or from passive data collection techniques described below. No Personal Information is included in Aggregate Information.

All data stored by us is only used for internal processing and is never sold or otherwise given away. In addition to that, we use the following third-party services which also store data about you:

  1. Amazon Web Services (for data)
  2. Google Cloud (for data)
  3. OpenAI (for data)
  4. Google Analytics (for statistics)
  5. Stripe.com (for payments)
  6. Intercom.com (for customer support service)
  7. Hubspot.com (for customer support service)
  8. Amplitude.com (for statistics)
  9. Sentry.com (for statistics)

Accessing your information on third-party resources

Some of TopTechPhoto inc. products or services may need to access your information stored on third-party services, such as Google Drive, DropBox, Amazon S3, or private entrepreneurs providing software development and support services etc. Access to the information is always limited to the scope of the product or the service. Our services always access data or content within a specific scope, such as folders, buckets, collections, etc. The scope of access is a subject of consent accepted by a user during the user initiation. No information from third-party services will be published, viewed, or accessed in any other way without the user’s explicit action.

For the purposes of processing data of citizens and residents of EU Member States, please be aware that TopTechPhoto inc. may engage third parties acting on its behalf to assist in satisfying its obligations in accordance with this Data Processing Agreement ("DPA"), and to delegate all or part of the processing activities to such sub-processors.

TopTechPhoto inc. will enter into contractual arrangements with such sub-processors requiring them to guarantee a similar level of data protection compliance and information security to that provided for herein. For example, we may share your personal data with the sub-processors who are contractors in Ukraine, if it is necessary for providing Services. Since these are contractors outside the EU, to protect your personal data we sign with them data processing agreements which include standard contractual clauses, as well as non-disclosure agreements.

If you are from a European Union Member State

This section contains information for our Customers from EU Member States, which include all residents of European Union Member States, regarding the collection and processing of their personal data by the Controller in accordance with GDPR, also known as Regulation (EU) 2016/679 of 27 April 2016 or General Data Protection Regulation.

All information required regarding the Controller under Art. 13 and 14 GDPR is provided either in this section or in other sections of this Policy (namely, “About us” section refers to the identity and contact details of the Controller; “How we use your information” section covers the purposes, “How we collect information from you” section refers to the types of information we collect, sections “Security and storage information” and “Accessing your information on third-party resources cover the categories of recipients of your data”, section “Personal information and content” answers for the retention periods etc.).

The legal basis for the processing of personal data is the performance of the contract. We collect and process most of the personal data to fulfill our contractual obligations under our Terms of Service, that is for the performance of the contract.

Also, we may collect some of your data on the basis of our legitimate interests. But this is only if our legitimate interest is not overridden by your rights to privacy. The legitimate interests we have with regard to the use of your data:

  • to prevent fraud or the violation of our terms and policies;
  • our business development through sending you emails to keep you informed of all changes, innovations, and improvements we make within the Service (refers to information only about similar products or services, and on the emails that you provided in the context of the sale of our Service);
  • to avoid risks of the loss of the data within our systems, to maintain and enhance our user’s safety and security, enable or administer our business (quality control, consolidated reporting, customer service), transfer of ownership etc.

Partly we are processing your data for the legitimate interests of third parties, too (e.g. our contractors), provided that such processing shall not outweigh your rights and freedoms.

To exercise your rights listed below, you can send a request to us at privacy@pics.io. In order to properly protect your data, we may take additional measures to identify you when processing your request. We will provide you with a response to your request no later than 1 month from the date of its receipt, except as provided by law.

Thereby, you have the right to:

  1. Know about the sources of collection, the location of your personal data, and the location of the controller of personal data.
    We respect the rights of personal data subjects and provide all necessary information in an accessible and understandable format. This policy was created to ensure this right.
  2. Receive information on whether personal data is processed, and, if so, access to the content of such personal data and information regarding the conditions of such processing, the recipients and third parties to whom personal data is transferred as well as full copies of the personal data undergoing processing.
  3. Submit a reasoned request to us objecting to the processing of your personal data.
    If the review of such a request reveals that the Group cannot demonstrate a valid legal basis for the processing of data that overrides your interests, rights, and freedoms, we will stop processing it and inform you about it.
    If the request is not satisfied, we will provide you with a reasoned response to the refusal.
  4. Obtain a copy of the personal data that you previously provided to us in a portable and, to the extent technically feasible, readily usable format that allows the consumer to transmit the data to another controller without hindrance where the processing is carried out by automated means.
    Under the GDPR, you may exercise this right in terms of your personal data that is processed on the basis of consent or the performance of the contract, if the data is collected directly from you and not created by the Group.
  5. Submit a request to restrict processing or erase personal data by the Group concerning them if such data are processed illegally or are inaccurate or where the law provides such an opportunity.
  6. Make a reasoned request to change your personal data if such data are processed illegally or are inaccurate or incomplete.
    In particular, in the event of any inaccuracies in the data processed by the Group, the person whose personal data are processed has the right to contact us with a request to make appropriate changes to their personal data.
  7. To have your personal data immediately deleted by the Group when such data is no longer required for the purposes for which it was originally collected, has otherwise been processed or you revoke the consent or where the law provides such an opportunity.
  8. To be informed of any rectification or erasure of personal data or restriction of processing, of each recipient to whom the personal data have been disclosed, unless this proves impossible or involves disproportionate effort. You have the right to be informed about those recipients if there is a corresponding request from the user.
  9. Revoke the consent of the processing of personal data if the consent is the legal basis for processing.
  10. Lodge a complaint with a supervisory authority or to the court and apply legal remedies in case of violation of the legislation on personal data protection.

TopTechPhoto inc. services let you share information with others. Remember that when you share information publicly, it may be indexable by search engines. Our services provide you with different options for sharing and removing your content.
